These Terms of Use ("Terms") govern your access to and use of the Miracley iOS application and this website (together, the "Service"). Miracley is operated by Haithem Bouzid ("Miracley," "we," "us," "our"). By downloading, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 16 years old (or a higher minimum age of digital consent in your region, where applicable) to use Miracley. If you are under the age of majority where you live, you confirm you have a parent or guardian's permission to use the Service.
2. Your account
You may create an account via Sign in with Apple or Sign in with Google. An account is required to use the Service. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account.
3. Subscriptions, pricing, and auto-renewal
Miracley offers auto-renewing subscriptions ("Subscription") purchased through your Apple ID account, governed by Apple's App Store Terms in addition to these Terms:
- Payment is charged to your Apple ID account at confirmation of purchase.
- Miracley currently offers: a Weekly plan at $4.99/week; a Monthly plan at $9.99/month; and a Yearly plan at $39.99/year. Exact pricing is displayed in the app before purchase and may vary by region.
- Subscriptions automatically renew for the same duration and at the then-current price unless auto-renew is turned off at least 24 hours before the end of the current period.
- Your account will be charged for renewal within 24 hours prior to the end of the current period, at the cost of the renewal period.
- You can manage your subscription and turn off auto-renewal at any time by going to your Apple ID Account Settings after purchase — Miracley itself cannot process cancellations, as all billing is handled by Apple.
- Refunds: all purchases are billed through Apple. Refund requests must be submitted directly to Apple via reportaproblem.apple.com — Miracley cannot issue refunds directly, as we do not process payments ourselves.
- Subscription and entitlement status is managed on our behalf by our subscription infrastructure provider, RevenueCat, based on confirmation received from Apple. We do not store your payment card information.
- Prices are as displayed in the app at the time of purchase and may vary by region and are subject to change; if prices change, we will provide notice as required by Apple's guidelines before any change applies to you.
4. U.S. state-specific subscription disclosures
We intend the following disclosures to satisfy applicable U.S. state automatic-renewal laws, including California's Automatic Renewal Law (Cal. Bus. & Prof. Code §§ 17600–17606) and similar laws in other states:
- Clear terms before purchase: the subscription's length, price, and auto-renewal terms are presented to you in the app before you confirm any purchase through the App Store.
- Easy cancellation: you may cancel auto-renewal at any time through your Apple ID Account Settings, at no charge, and the cancellation mechanism is at least as easy to use as the sign-up process.
- Material term changes: if we materially change the terms of your subscription (for example, a price increase), we will provide notice as required by applicable law before the change takes effect for you.
- California residents may also contact the California Department of Consumer Affairs with any unresolved complaints, as required by state law.
5. Acceptable use
You agree not to: use the Service for any unlawful purpose; attempt to disrupt, reverse-engineer, or gain unauthorized access to the Service or its underlying systems; upload or transmit content that is unlawful, abusive, or infringes the rights of others; or use the Service in any way intended to harm minors.
6. Your content
You retain ownership of journal entries, photos, and other content you create within Miracley ("Your Content"). You grant us a limited, non-exclusive license to store and process Your Content solely to provide and improve the Service to you. We do not claim ownership of Your Content and will not use it for any purpose beyond operating the Service, unless you separately and explicitly consent.
7. AI-generated content
Certain content within the Service — including your daily affirmation and short reflective lines — is generated using artificial intelligence models, based on information you have provided. This content is intended for personal motivational and reflective purposes only. It is generated automatically and, while designed to be relevant to your stated goals and context, is not reviewed by a human before being shown to you, and does not constitute professional advice of any kind.
8. No medical, psychological, or professional advice
Miracley is a wellness and self-reflection tool, not a healthcare service. It is not a substitute for professional medical, psychological, or mental health care, diagnosis, or treatment. If you are experiencing a mental health crisis or emergency, please contact a licensed professional or emergency services in your region immediately.
9. Intellectual property
The Service, including its design, text, graphics, software, and the Miracley name and logo, is protected by applicable intellectual property laws. Except for Your Content, nothing in these Terms grants you any right to use our trademarks, logos, or other proprietary assets.
10. Account termination and deletion
You may permanently delete your account and associated data at any time via Settings → Delete Account within the app, in accordance with Apple's App Store guidelines requiring in-app account deletion. We may suspend or terminate your access to the Service if you violate these Terms.
11. Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.
12. Limitation of liability
To the fullest extent permitted by applicable law, the operator of Miracley shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from or related to your use of the Service, even if advised of the possibility of such damages. Our total liability to you for any claims arising under these Terms shall not exceed the amount you paid to us in the twelve months preceding the claim. Nothing in these Terms limits any liability that cannot be excluded or limited under applicable law, including mandatory consumer protection law in your country of residence.
13. Third-party terms
The Service integrates with third-party providers including OpenAI, ElevenLabs, Supabase, and RevenueCat, and (where you sign in with them) Apple and Google. Your use of these integrations is subject to those providers' respective terms and privacy policies. We are not responsible for the availability, accuracy, or conduct of any third-party service. Your use of the Service is also subject to Apple's standard End User License Agreement (available at apple.com/legal/internet-services/itunes/dev/stdeula) where applicable, which takes precedence over these Terms solely with respect to any conflict specifically concerning that agreement's subject matter.
14. Changes to these Terms
We may update these Terms from time to time. Continued use of the Service after any changes take effect constitutes your acceptance of the revised Terms. Where changes are material, we will provide reasonable notice within the app.
15. Governing law
These Terms are governed by the laws of France, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of Paris, France, unless mandatory consumer protection laws in your country of residence require otherwise.
